WRIT OF HABEAS CORPUS

The term habeas corpus is a Latin term which translates into the term “you must have the body”.  However, recent developments of law suggest that the writ of habeas corpus includes the  production of the body of the person alleged to be unlawfully detained is not essential.

WRIT OF MANDAMUS

The writ of mandamus is a judicial remedy, which is issued in the form of an order from the Supreme Court or a high court to any constitutional, statutory, or non-statutory agency. In order to do or to forbear from doing some specific act, which that agency is obliged to do or ought to refrain from doing under the law and which is in the nature of a public duty or statutory duty.

WRIT OF PROHIBITION

The rate of prohibition is a judicial order which is issued by the Supreme Court or a high court to any constitutional statutory or non-statutory agency to prevent such agencies from continuing the  proceedings, which is in excess or abuse of their jurisdiction or which is in violation of the  principles of national justice or which is in. Contravention of the law of the land.
