Artificial Intelligence and Personal Data Protection Bill 2022

In the words of John McCarthy,  Artificial Intelligence is the Science and engineering of making intelligent machines. In simpler terms, this means that machines and computer systems would function as per the intelligence of Human beings which is input by the humans. John McCarthy is known as the father of Artificial Intelligence ( AI ). He was an American Computer Scientist and the term Artificial intelligence was coined by him. This is a heated topic since the past so many years and apparently will blow up extensively in the upcoming years also.

The technology of Artificial Intelligence has significantly contributed to the overall development across the globe. It’s advantages include:

  1. It can store and process large amounts of data and give a rationalised output.
  2. It can operate 24/7 without being lethargic.
  3. It can perform multiple tasks at once.
  4. Virtual assistants such as Siri , Google, and Alexa can answer the human voice and decode the solutions to the doubts of individuals.
  5. It can learn multiple languages and hence the translation of the data becomes simple.
  6. The use of Artificial Intelligence has increased accuracy and efficiency of the work .
  7. Analysing relevant data and helping in organisation of files is also a beneficial factor of Artificial Intelligence.

Disadvantages of Artificial Intelligence :

  1. The work that humans do with the power of their mind is transferred into computer systems and machines which lets the devices perform the tasks. This causes job displacement.
  2. A human has a brain as well as a heart for empathy towards other human beings. This is a point where machines with artificial intelligence lack. They can deal with logical reasoning but cannot be creative and compassionate as humans are regarding their work and society as whole.
  3. Variety of bias is formed because of the use of this technology. Such as when machines are built by a single gender ; encompassing homogeneous information into computer systems. More often this baises  is a result of human prejudices and stereotypical thoughts which are used to train machines.
  4. Security concerns have also arised due to its usage. People intend to use AI for malicious purposes in order to  commit scam or fraud. Data could be breached , cybercrimes, and risk of virus attacks are the common issues with respect to disadvantages of Artificial Intelligence.

However, these security and privacy concerns are one of the core problems when using Artificial intelligence. The enormous amount of data is entered into the machines and devices to train them and make them intelligent as human beings is a hectic task and requires resourceful team and meticulous work efforts.

The computer systems can store gazillions of information into them and process them for several purposes which could lead to aberrant outcomes. It could misuse the personal data of the individuals leading to risk of leakage of the information to dangerous third parties. Generation of virus and malware softwares could lead to attacks on the data stored in the devices. Getting control over the sensitive information of humans is also one of some ways that leads to violation of data through the use of AI.

There are no statutory laws that regulate Artificial Intelligence and hence no provision has been laid for any safeguards. However , time and again after seeing the rapid growth of Artificial Intelligence, certainly, security guidelines and acts have been passed for the purpose of data protection. Personal Data Protection Bill, 2022

It’s a revised one after 2019. And now it may also be called The  Digital Personal Data Protection Act, 2022.

It Aims at preventing unauthorised access to the data of the individuals. To the conformity of the bill, , the Data Protection Board has been established. This bill states the authorities and institutions that can lawfully use personal information of specific individuals. For any corrupt practices, they hold such companies to be accountable and can impose penalties upto 500 crores. If a user submits false documents while signing up for an online service, or files frivolous grievance complaints, the user could be fined up to Rs 10,000.

The Centre has been empowered to exempt its agencies from adhering to provisions of the Bill in the interest of sovereignty and integrity of India, security of the state, friendly relations with foreign states, maintenance of public order or preventing incitement to any cognisable offence.

This bill also talks about Data principal and Data Fiduciary. Data Principal refers to the individual whose data is being collected. A Data Fiduciary is the entity (individual, company, firm, state etc), which decides the purpose and means of the processing of an individual’s personal data. This grants individuals a right to give their consent before disclosing their sensitive information to the fiduciary parties.

Therefore, the bill has a kind of reformed the manner in which AI uses a person’s data and performs a cycle of operation on it. As the saying goes, there are always two sides of a coin. So even if Artificial Intelligence has a profound impact on the growth and development of our nation that leads to its advancement, yet, the negative side that comes along must not be ignored. The cyber crimes are being committed at a countable rate for which the government should act reasonably and put restrictions on its misuse.

Apart from it , the  users should also be aware enough to read the instructions carefully before signing up online on any platform and not just scroll recklessly. Knowledge should be imparted to the people about the security and threats of Artificial Intelligence so that they know to only use encrypted websites and act accordingly.
