Since AI primarily feeds on large amounts of data, there are times when concerns over the protection of privacy rights arise, especially in the wake of new legislation like the Data Protection Act, 2023. Understanding the Right to Privacy

This is specifically important for international corporations using AI technologies, to check their compliance with Indian data storage laws.
- Sanctions and Enforcement: The act imposes some pretty harsh penalties for failing to comply, including large fines for violations of personal data. The act further ensures that it forms a Data Protection Authority (DPA) responsible for the administration of the act and follow-up on their actions to ensure that bodies meet set requirements.
- Data Subject Rights: The DPA 2023 grants several rights to individuals. Some of the benefits include the right of access, correction, and erasure of personal data; though this would indeed give an individual greater control over their personal information at the time such data is used on AI-related services.

- Justice K.S. Puttaswamy (Retd.) vs. Union of India (2017)[2]: The issues had been dealt with earlier, but one very important case was the Justice K.S. Puttaswamy case. To minimize the risks of AI and to do the same towards privacy protection, some legal measures to be taken include:
- Algorithmic transparency: The policymakers should enforce that such AI systems have an explanation of their conclusions so the decision-taker learns how their data is being used and what decision was reached.
- Regulation of Data Brokers: Organizations in business about personal data for sale must be more strictly governed in the sense that they need to obey privacy laws.
- Ethical AI Frameworks: Governments and firms should look into implementing some ethical AI frameworks that uphold the respect of privacy and responsible usage of personal data.
- Periodic Audits: Periodic audits of the AI should be ensured which prove whether the laws set forth for data protection have been followed or not to avoid such breach and ensure accountability.
