Case Brief;
Dr.Abhaya, a second year postgraduate trainee doctor at the RG Kar Medical College in Kolkata, West Bengal, was reported missing by co-workers on August 9, 2024 when she failed to show up for the ward after finishing her shift. She went on for a rest after putting in 36 hours of nonstop work. The following day, the trainee doctor’s body was found in one of the college’s seminar rooms. She was partially nude, with blood coming from her mouth, eyes, and genitalia. Her legs were erect, suggesting that she had suffered serious pelvic damage. Moreover, it was found that there was considerable bleeding due to broken and lodged spectacle lenses in Dr.Abhaya’seyes, caused major damage to her eyes.
Later, it was determined that she had died.Lately, the body was autopsied and an unnatural death complaint was filed.The family of the victim was intimated that their sole pride, Dr.Abhaya committed suicide. Upon reaching the hospital, the bereaved family was kept waiting outside for three hours without being allowed to see their daughter’s body.
Sanjay Roy, a volunteer with the Kolkata Police disaster management team who was stationed at the police outpost close to the medical campus, was taken into custody by the police after an investigation. He has confessed the heinous crime as well.
Autopsy Report;
Following a sexual assault and rape, Dr.Abhaya was strangled to death, according to an autopsy. A deep cut in her vaginal system, lips, left leg, right hand, ring finger, neck, and cheek was also mentioned in the repot. The investigation states that she was strangled and pressure was applied to her mouth and throat, breaking the thyroid cartilage. In addition, her mouth, eyes, and genitalia were all bleeding, and the report described “perverted sexuality” and “genital torture” as the causes of her genital injuries.The vaginal swab contained about 150 mg of semen, according to the post-mortem report. The investigation revealed that she was brutally gang-raped and murdered. But, asserting that it is hard to tell semen from many individuals with the naked eye during an autopsy, the Kolkata Police have written off these assertions as hearsay.
Public’s Reaction;
The tragedy caused national indignation, particularly in the medical community, and received extensive media coverage. Colleagues of the deceased and student unions called for increased security on campus as well as justice.The Indian Medical Association (IMA) responded by requesting that Union Health Minister J. P. Nadda file a specific central law designed to stop violence against medical professionals. They also demanded that safe zones be established around hospitals. This call came after resident physicians nationwide staged massive protests and strikes in response to the incident, which created grave worries for the security of medical personnel.India’s medical community has been participating in protests, strikes, candlelight marches, and temporary refusals to treat non-emergency patients since August 9.
In reaction to the rape and murder of a doctor, medical professionals across ordered a 24-hour closure, and hospitals and clinics started to turn away patients except in cases of emergency. On August 14, demonstrations under the banner “Women, Reclaim the Night” took place in Kolkata and other Indian cities.”For Women’s Independence on the Midnight of Independence” is how the protest is characterized, and it should be noted that the demonstrations continued through August 15, India’s Independence Day.
After a number of protestors overturned a barricade and entered the hospital on August 15, just after midnight, police used tear gas and baton charges against the gathering. The perpetrators damaged the emergency ward and the area where the victim was discovered in addition to throwing stones at the hospital’s property.This has led to severe criticism of State Government and their inabilities to prevent the ongoing crimes against the society. Also,the college principal, Sandip Ghosh’s resign amidst the ongoing protests provoked even more resentment.Protests were not only held nationwide but also, internationally in Australia, Bangladesh, Pakistan, Canada, Germany, the United Kingdom, and the United States as a result of the incident’s widespread media coverage.
India’s medical community has called the episode “barbaric,” citing the absence of safe places for women and the unbridled violence brought on by lax security measures. They want hospital security procedures to follow the same strict guidelines as airport security.
The first step is designating hospitals as safe areas with required security measures. Security personnel deployment, CCTV installations, and other procedures can be implemented. Also, the 2020 adjustments to the Epidemic Diseases Act of 1897 are one of the changes that the doctors are requesting be incorporated into the draft of “The Healthcare Services Personnel and Clinical Establishments (Prohibition of Violence and Damage to Property Bill 2019).” A comprehensive review of the housing and working conditions for resident doctors is being called for, with concerns about long, late night shifts like the victim’s 36-hour shift and the dearth of secure areas and functional facilities being addressed.
Along with the demands for justice to be served and proper and dignified compensation for the bereaved family, which reflects the intensity of the inflicted cruelty, there are also expectations for a thorough and professional investigation of the crime within a fair timeframe.
